1. Introduction

These Terms of Service ("Terms") govern your use of the Ozmoz application ("App") provided by Ozmoz AI ("we", "us", or "our"). By installing, accessing, or using our App, you agree to these Terms, which form a legally binding contract between you and Ozmoz AI. If you do not agree to these Terms, do not use the App.

2. Privacy and Data Security

Your privacy is a core principle of our App. As described in our Privacy Policy, available on our website, all your configuration data, history, and API keys are stored exclusively on your local device. We do not collect, transmit, or store this personal data. You are solely responsible for the security of the data on your own device.

3. User License

We grant you a personal, non-exclusive, non-transferable, and revocable license to use the App for your own personal or internal business purposes, in accordance with these Terms. You are responsible for maintaining the confidentiality of your license key and any API keys you use with the App. You are fully responsible for all activities that occur under your license.

4. Subscriptions, Payments, and Cancellations

The App may be offered under different subscription plans, including a free version and paid subscriptions ("Pro", "Teams"). Features and pricing are detailed on our website. Payments are processed through our third-party provider (Stripe). Subscriptions are billed in advance on a recurring basis and will automatically renew unless you cancel your subscription before the renewal date. You can cancel your subscription at any time from your account settings. Your access will continue until the end of the current paid period.

5. Refunds and Right of Withdrawal

For consumers within the European Union/EEA: In accordance with Article L 221-18 of the French Consumer Code and EU directives, you have a right of withdrawal of 14 days from the date of your initial purchase, without needing to provide a reason. To exercise this right, please contact us. We will provide a full refund within 14 days of your request.

For all other users: We offer a 14-day refund policy on your initial purchase. After this 14-day period, payments are non-refundable to the fullest extent permitted by law.

6. Restrictions on Use

You agree not to do any of the following:

  • Use the App for any illegal or unauthorized purpose.
  • Reproduce, copy, modify, decompile, reverse engineer, or create derivative works from any part of the App.
  • Attempt to gain unauthorized access to our systems or disrupt the service for other users.
  • Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on the App.

7. Intellectual Property

All intellectual property rights in the App, including its visual design, content, logos, and source code, are the exclusive property of Ozmoz AI and its licensors. These rights are protected by French and international intellectual property laws. This license does not grant you any ownership rights.

8. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE," without any warranties, express or implied. We do not guarantee that the App will be uninterrupted, secure, or error-free. We are not responsible for any malfunctions or disruptions caused by third-party services (such as API providers) or network issues beyond our reasonable control.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Ozmoz AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or business interruption) arising from your use of, or inability to use, the App. Our total liability to you for any and all claims related to the App is limited to the total amount you paid us for the App in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your license and access to the App at any time, without prior notice, if you breach these Terms. Upon termination, you must immediately cease all use of the App and destroy any copies in your possession.

11. Changes to These Terms

We may modify these Terms from time to time. We will notify you of significant changes by posting the new Terms on our website or through the App. Your continued use of the App after the changes take effect constitutes your acceptance of the new Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of France, without regard to its conflict of law principles.

For consumers residing in the European Union: You benefit from the mandatory consumer protection provisions of the law of your country of residence, and you may bring any legal proceedings in connection with these Terms before the competent courts of your place of residence or the courts of France.

For all other users: Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the competent courts of Paris, France.
